Lucio, his family, advocates and lawyers say he was convicted of wrongful death in the 2007 death of his child, Maria. 

In a statement shared by his legal team, Lucio said, "I thank God for my life. I have always relied on him. 

 In the trial, prosecutors argued that Lucio was an abusive mother, which likely caused the injuries leading to her daughter's death but Lucio and 

Her lawyers said that Maria's injuries were not caused by abuse, but by falling from a ladder outside the family's second-floor apartment two days before her death. 

 Of the nine claims Lucio raised in his acquittal application, the appellate court ordered the trial court to consider four of them, including his claim that he was innocent 

According to Lucio's lawyers, the trial court in Brownsville will proceed to hear evidence of Lucio's innocence.  Court then Texas Court of for criminal appeals
